Employees of the Sponsor, TriCoast Worldwide, and any entity involved in the creation, promotion or administration of the Sweepstakes and Contest and/or SMITTY the movie and their respective partners, parent companies, divisions, subsidiaries, affiliates, trustees, franchisees, licensees, advertising, promotion and public relations agencies and their respective officers, directors, employees, agents, independent contractors, representatives and agencies (collectively the “Sponsor Affiliates”) are not eligible to participate in the Sweepstakes and/or win a prize. Additionally, relatives of, and those living in the same household as, such employees are not eligible to win. For the purpose of this Contest and Sweepstakes, relatives are defined as mother, father, in-laws, grandmother, grandfather, brother, sister, children, and grandchildren.
How to enter:
Register and vote for your pet organization at www.SmittyTheMovie.com
Only one vote is accepted per person.
All fields on the submission form must be completed in order for entries to be accepted.
No purchase necessary.
In order to submit entries, entrant must be 18 or older.
Sponsor will not be responsible for Internet connections, unavailability of servers or any other technical malfunctions or failure to receive transmission of an entry regardless of the reason.
Only entries sent to the designated entry web site shall be eligible.
Prizes:
Grand Prize: The organization with the most votes will be promoted by a poster placement in the upcoming family movie, “SMITTY”
Eligibility for random prize drawing for pet supplies, once your organization accumulates 50 votes.
“SMITTY” movie poster will be awarded to organizations that accumulate 25 votes or more.
Tickets to the “SMITTY” premier will be awarded to organizations with the most votes.
Top 10 organizations will be highlighted in the DVD Special Features.
Other prizes to be announced.
Selection of Winner:
Grand Prize will be based upon the organization that obtains the highest number of votes. The organization will enter a poster, which must be approved by TriCoast Worldwide, to be placed in “Smitty”. If the poster cannot be conformed, within 5 days, to meet the approval of TriCoast Worldwide, an alternate winner will be determined.
Other prizes will be determined by a random drawing from all eligible entries that receive 50 votes or more, and SMITTY posters will be awarded to organizations that receive 25 votes or more.
The winners will be notified by the email supplied at time of registration. The Administrator will make three (3) attempts to contact the potential winners via email within 24 hours from the time winner determination was accomplished. If Administrator is unable to reach the potential winners via email within this time frame, he/she will be disqualified and alternate winners will be determined. Sponsors are not responsible for and will not be held liable for late, lost, misdirected, or unsuccessful efforts to notify winners.
Odds of winning will be determined by the number of eligible entries received. On or about October 1, 2010, winners will be selected and tentatively declared winners subject to eligibility confirmation and compliance with these rules.
Winner may be required to sign and return a release of liability, affidavit of eligibility, and, where lawful, a publicity consent agreement. By accepting and/or using the prize, winner agrees to the use of their organization name for the purpose of advertising or promoting without further compensation, unless prohibited by law.
If a selected winner cannot be contacted, is ineligible, fails to claim a prize, or fails to timely return the releases required, prize will be forfeited and an alternative winner will be selected.
The Grand Prize winner will be notified by email.
By entering each contestant agrees to be bound by the rules.
Prize will not be released until Smitty the Movie receives all required documents.
The Grand Prize is non-transferable. There may be no cash or other substitutions of prizes by the winner.
Each Winner, upon request of the Sponsor, must supply documented proof of age, identity and eligibility within two (2) business days of being contacted by Smitty the Movie representatives.
Participation:
By participating in the Contest, participants release and hold TriCoast Worldwide harmless from any and all actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, claims based on publicity rights or invasion of privacy.
TriCoast Worldwide may reproduce, publish, display, edit, modify, and otherwise use the material for any purpose in any form and on any media.
Limitation on Liability/Disclaimer/Other Requirements:
Certain of entrant’s personally identifying information may be disclosed to third parties as required by law; including, without limitation, on a winner’s list.
Entrant forever and irrevocably releases, indemnifies and holds harmless each of the Sweepstakes Entities, and each of their respective officers, directors, employees, representatives, agents, shareholders, successors and assigns, from any liability, claims, demands, judgments, proceedings, causes of action, lawsuits, injuries, death, costs, expenses or damages, due to any injuries, damages or losses to any person (including but not limited to death) or property of any kind, arising from, resulting from, or in connection with, directly or indirectly, in whole or in part, from the Contest and Sweepstakes, or any Contest-related activity, or the entrant’s acceptance, use, misuse, inability to use, possession, travel related activity to, or defect of any prize, or any violation of entrants privacy, publicity, person and proprietary rights, or the collection, use and/or sharing of the entrant’s personally identifiable information by Sponsor or its designees; any change in the prizing (or any components thereof) due to unavailability, business or creative considerations, or due to reasons beyond Sponsor’s control, any late, lost, stolen, mutilated, misdirected, illegible, delayed, garbled, corrupted, destroyed, incomplete, undeliverable or damaged entries, any wrongful, negligent, or unauthorized act or omission on the part of any of the Contest Entities, or any of their agents or employees, lost, stolen, damaged, delayed, or misdirected baggage, lost, late, stolen, misdirected, damaged, or destroyed prizing (or any element thereof), and any typographical errors in these Official Rules or any Contest promotional materials. The Sponsor reserves the right, in its sole discretion, to cancel, suspend, and/or modify this Contest.
Travel is not included with any of the prizes.
Internet:
If for any reason, the Internet-related portion of this Contest is not capable of running as planned, including infection by computer virus, tampering, fraud, technical failure, or any other cause which corrupts or threatens the administration, security or integrity of the Contest, the Sponsor reserves the right, in its sole discretion, to terminate or suspend the Contest or any portion of the Contest. Any attempt to damage or undermine the fair and legitimate operation of this Contest will result in disqualification from the Contest.
Governing Law:
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsors in connection with the Contest shall be governed by and construed in accordance with the laws of the State of California, USA, without giving effect to any choice of law or conflict of law rules or provisions.
